Welcome to Cyber Calling Card ("CCC," "we," "us," or "our"). By activating a Cyber Calling Card, creating an account, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. About the Service

Cyber Calling Card is a digital identity and contact-sharing platform. We provide physical cards embedded with NFC technology and QR codes that link to digital profiles hosted on our platform. Our service enables users to share their professional and personal contact information electronically.

2. Eligibility

You must be at least eighteen (18) years old to use this service. By registering, you represent and warrant that you meet this age requirement.

3. Account Registration

3.1 Account Creation

When you activate a Cyber Calling Card, you will be asked to create an account by providing your email address, a secure password, and profile information. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your account. We encourage you to use a strong password (at minimum twelve characters, with a mix of uppercase letters, lowercase letters, numbers, and symbols) that is unique to your CCC account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3.3 One Account Per Person

Each individual may maintain one (1) account on the platform. A single account may be associated with multiple Cyber Calling Cards, each linked to a separate profile.

4. Card Activation and Ownership

4.1 Activation

Each physical Cyber Calling Card contains a unique code and a separate activation PIN. The PIN is required to activate the card and link it to your account. Cards must be activated within the validity period indicated at the time of purchase or issuance. Unactivated cards may expire.

4.2 Non-Transferability

Activated cards and the associated accounts are non-transferable. You may not sell, trade, or transfer your activated card or account to another person.

4.3 Card Expiry

Cards that are sold but not activated within the specified period (typically ninety days from the date of sale) will expire. Expired cards may be reactivated at the sole discretion of CCC administration.

5. Profiles and Content

5.1 Profile Information

When you activate a card, you create a digital profile that may include your name, job title, company, contact details, photograph, company logo, website URL, and physical address. This information will be published on a publicly accessible profile page and encoded into a downloadable vCard.

5.2 Public Display Consent

By submitting your profile information, you acknowledge and consent that:

  • Your profile will be published on a publicly accessible webpage.
  • Your contact details will be encoded into a QR code and vCard that can be scanned and downloaded by anyone who accesses your profile page or scans your physical card.
  • Search engines may index your public profile.

5.3 Content Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of the information you provide. You represent and warrant that:

  • All information you submit is truthful and accurate.
  • You have the right to use and publish any images (photographs, logos) you upload.
  • Your profile content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
  • Your profile content does not contain false, misleading, defamatory, obscene, or unlawful material.

5.4 Prohibited Content

You may not use your profile to:

  • Impersonate another person or entity.
  • Publish false or misleading contact information.
  • Distribute spam, malware, or phishing links.
  • Promote illegal activities or substances.
  • Upload content that is obscene, hateful, discriminatory, or threatening.

We reserve the right to remove any content and suspend or terminate any account that violates these Terms, without prior notice.

6. Vanity URLs (Slugs)

6.1 Availability

You may choose a custom vanity URL (slug) for your profile, subject to availability and our reserved terms list. Slugs must be between three (3) and thirty (30) characters and may only contain lowercase letters, numbers, and hyphens.

6.2 No Ownership Rights

Assigning a slug to your profile does not grant you any ownership rights over that slug. We reserve the right to reclaim, reassign, or retire any slug at any time, for any reason, including but not limited to trademark disputes, policy violations, or platform reorganization.

6.3 Slug Transfer

You may transfer a slug between your own profiles, subject to the rate limits and conditions specified by the platform.

7. Privacy

Your use of the service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

8. Intellectual Property

8.1 Our Property

The Cyber Calling Card platform, including its design, software, logos, trademarks, and all related intellectual property, is owned by CCC and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our platform or its content without our express written permission.

8.2 Your Content

You retain ownership of the content you submit to the platform (photographs, logos, text). By submitting content, you grant CCC a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content solely for the purpose of operating and providing the service.

9. Account Deactivation and Termination

9.1 Voluntary Deactivation

You may deactivate your account at any time through the account settings page. Deactivation will immediately remove your public profiles from visibility. Your data will be retained for a grace period to allow for possible restoration.

9.2 Termination by CCC

We may suspend or terminate your account at our discretion if we believe you have violated these Terms. We may also deactivate accounts that remain inactive for an extended period.

9.3 Effect of Termination

Upon termination, your public profiles will be removed from visibility. Certain records (including consent records and activation logs) will be retained as required by law.

10. Disclaimers

10.1 "As Is" Service

The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 No Guarantee of Availability

We do not guarantee that the service will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue any part of the service at any time without notice.

11. Limitation of Liability

To the fullest extent permitted by applicable law, CCC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the service.
  • Any unauthorized access to or alteration of your content.
  • Any conduct or content of any third party on the service.

12. Indemnification

You agree to indemnify and hold harmless CCC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the service.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Cebu City, Philippines.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this document and, where appropriate, notify you through the platform. Your continued use of the service after the effective date of any changes constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
